There is a certain ambiguity in Descartes’ Meditations, as there is any great sphere of endeavor. How, after all, does one bridge the gap between the autobiographical “I” of the Discourse and the Meditations, and the world of learned scholarship; the “guardians of tradition”, both religious and temporal? How does one mediate the way in which one is received by the tradition which has so eloquently been put out of play in the pursuit of one’s personal project? In short, how (...) can Descartes ensure that his pioneering work is not misunderstood; that it is not viewed as a threat to religious and national institutions?In reflecting on these questions, I believe Descartes arrived at a concept of community which sought to balance personal autonomy with institutional obligation in such a way that the scientist’s ultimate judgment was preserved, while proximately acknowledgement was made of the prevailing scientific and religious “world picture”, and only challenged obliquely.Thus, there is a certain tension in Descartes’ theorizing about community, a tension which was quite naturally carried over into his practical community relationships. Furthermore, I will argue that Descartes’ “tool” for getting around in these tension filled community situations is what I shall call his doctrine of “order and intention”. Ultimately, it is this reliance upon intentionality which throws his “balance” out of balance, and gives rise to repeated charges of “dissimulation”. How this situation came to pass, and Descartes’ tortuous attempts at resolving the emerging problems, is largely the subject of the following pages. (shrink)

Rutherford and Lindell (2011) review an extensive literature on lateralization of emotion. As they note, an important issue surrounding this question is the nature of emotion, which bears on what, precisely, is lateralized. The present comments are intended to broaden the context of the review, by considering lateralization from the standpoint of a bivariate model of evaluative processes and a neuroevolutionary perspective.

In this paper, we draw upon the emerging view of strategic cognition and issue salience and show that CSR giving has evolved into more than an altruistic response to being asked for support, to one which is embedded in the strategic frames of management and which supports organizational identity. The managerial action as a result of such strategic cognition suggests that modern organizations are seeking to develop CSR giving processes that provide them with a competitive advantage. We draw on the (...) resource-based view of organizations and the VRIO framework to provide the theoretical foundations for our argument that CSR implementation in the form of corporate giving to charities can be developed as a dynamic capability. This can provide a competitive advantage by allowing organizations to manage key stakeholder relationships more effectively with benefits which could lead to increased organizational productivity and the ability to execute strategy more effectively. We interview CSR implementation managers from large organizations in Australia and find that the CSR giving process in many firms is evolving into a more sophisticated and strategically motivated process with expectations of a return. Central to this evolution is the appointment of a CSR implementation manager who acts as a boundary spanner between the organization and its key stakeholders. We posit that this corporate investment in their role and supporting structures can lead to the better management of stakeholders by organizations through the dynamic capability of the CSR giving process. Mainstream economics evaluates capitalism primarily from the perspective of efficiency. Social philosophy typically applies other or additional normative criteria, such as equality, democracy, and community. This essay examines the implications of these contrasting sets of criteria in the evaluation of capitalism. Its first two sections consider the criteria themselves, assuming that a trade-off exists between them. The last three sections question whether such a trade-off necessarily occurs, and explore the claim that improvements in nonefficiency dimensions of capitalist society may enhance, (...) rather than conflict with, efficiency. Previous research has demonstrated electroencephalogram (EEG) changes in response to low-odor concentrations, resulting in near-chance detection. Such findings have been taken as evidence for olfaction without awareness. We replicated and extended previous work by examining EEG responses to water-water control, 0.0001, 0.001, 0.01, and 1 ppm isoamyl acetate (IAA) in water paired with water only. Detection was above chance (>50%) for .001 and above, and alpha decreased only to those concentrations, suggesting that EEG changes corresponded to IAA awareness. However, when (...) correct trial EEGs were compared to incorrect trial EEGs during .001 ppm, right posterior/central alpha decreased during incorrect trials and alpha decreased more globally (including frontal sites) during correct trials. These data may not reflect awareness or unawareness per se. Instead, results are discussed regarding activation of perceptual systems in the posterior region during incorrect trials and the activation of frontal action systems during a subset of correct trials. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. The purpose of this article is to provide one prominent perspective from the research literature on a conception of feedback in educational psychology as proposed by John Hattie and colleagues, and to then adapt these concepts to develop a framework that can be applied in music performance teaching at a variety of levels. The article confronts what we see as a lack of understanding about the importance of this topic in music education and provides suggestions that will help music (...) teachers refocus how they use feedback within their teaching. Throughout the article, we draw heavily on the work of John Hattie and his colleagues whose explanations on all facets of feedback, but especially those forms of feedback that are focused on ensuring students understand “where to next”—have had a huge impact on school education through various publications. BackgroundThe principal aim of this study was to investigate the function and effectiveness of an institutional policy that outlines a procedure to limit medically futile interventions. We were interested in the attitudes and opinions of careproviders and the members of the Yale New Haven Hospital Ethics Committee that use this policy, the Conscientious Practice Policy (CPP), to address questions on appropriate interventions in the setting of medical futility.MethodsIn 2019, we conducted three focus groups of members of the Yale New Haven (...) Hospital Ethics Committee and critical care physicians. We asked the participants questions concerning their use of the Yale New Haven Hospital’s policy on limiting futile interventions. Focus group transcript results were coded into common themes using a conventional analysis approach.ResultsThe overarching finding was that the CPP had various levels of interpretation that prevented its effective and consistent use. This was supported by the four main themes from the focus groups: (1) Mixed perceptions regarding communication between careproviders and family members and surrogates before the CPP was invoked contributed to complexity in decision making. (2) It was ineffective to use an ethics consultation to decide whether or not to invoke the CPP. (3) It was necessary to address moral distress in the absence of a policy. (4) The use of the CPP was inconsistent for different patients, based on the degree to which family members and surrogates persisted in their resistance to limiting medically futile interventions, careproviders’ comfort with directly making decisions, and bias towards members of certain groups.ConclusionThe CPP, as it has been used at the Yale New Haven Hospital, has been ineffective in rationally, fairly, and consistently resolving conflicts regarding the appropriateness of ending medically futile interventions. The CPP, as well as similar policies at other institutions, may benefit from restructuring the policy to more closely align with policies at other institutions where outcomes have been more successful. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

The thesis of incommensurability concerns the interrelation between subjective culture and objective culture through which the constitutive agency of chaos (incommensurability) emerges. The objectivations/products, the constituents of objective culture, carry their own Being, and this Being transcends the original subjective expressivities/intentions. The constitutive agency of this incommensurable interrelation becomes apparent in an age of globalization where its effects become global, bringing about dangerous socio-political volatilities. To illustrate, global warming has been neither the expressive intention of subjective culture nor a constituent (...) of energy per se as an objectivated product in the context of objective culture. It emerges in the interrelation, an unforeseen incommensurability, a chaos in the culture of energy that threatens the globe/world in various ways. Incommensurability, the cultural form of chaos, is recognized as dramatically foiling human instrumental rationality, spoiling its hubris or belief in its own progress. The doctrine of incommensurability shows that we can not know what we are doing while we are doing it, for the empirical manifestations of chaos are only knowable after the fact and its effects are unpredictable. This book of essays is divided into two parts: the first dealing with contemporary themes in subjective culture and the second with those in objective culture. A few of the pressing topics treated in this volume are: abstracted information of a computer-based society versus locally-based, grounded knowledge, abstracted neo-liberal economics versus place-grounded economics, the geo-politics of peak oil, and the intensification of natural disasters as a consequence of global warming reveal the tenuous character of the contemporary world. The precise relationship between the autonomic nervous system and emotion has been a topic of intense debate and research throughout the history of modern psychology. The present article considers some of the more influential theoretical frameworks that continue to drive contemporary research on the relationship between emotion and physiological processes. This volume represents some of the activities of the Boston Area Colloquium in Ancient Philosophy from the academic year 1997-98. It contains nine colloquia that were hosted by eight different colleges and universities in the greater Boston area. Discussions of the works of Plato dominate this volume, with six of the nine colloquia based on Platonic texts. Appropriately, the colloquia begin with an analysis of division in the ancient atomists.
